Chapter 71 of the Texas Civil Practice and Remedies Code, also known as the Texas Wrongful Death Act<\/a>, allows certain family members to sue for damages when a loved one is killed by the actions or inaction of another. If the death was caused by a wrongful act, carelessness, unskillfulness, neglect, or default of another person or corporation, a personal injury lawsuit should be filed<\/a>.<\/p>\n The purpose of a wrongful death lawsuit is to recover the \u201cfull value of the life\u201d of the deceased individual.<\/p><\/blockquote>\n In Texas, wrongful death claims can be subject to two separate statutes of limitations<\/strong><\/em> \u2013 the limitations period on the claim a deceased person could have filed and the limitations period for the plaintiff\u2019s own wrongful death claim.<\/p>\n A plaintiff generally has two years<\/strong> from the date of their loved one\u2019s death to file a wrongful death lawsuit.<\/p><\/blockquote>\n Wrongful death damages serve to compensate the family members for the losses experienced as a result of losing a loved one.
